Terms of Service

1. Agreement
By accessing CinemaMachina websites, client portals, or production services, you agree to these Terms. A signed proposal, statement of work, or other written production agreement may add to or replace specific terms for a project.
2. Services
CinemaMachina provides creative development and generative AI film production, including concept development, visual design, animation, editing, sound, and delivery. Scope, schedule, formats, review rounds, and fees are established in writing for each engagement.
3. Client materials and permissions
You represent that you have the rights and permissions necessary for all music, lyrics, trademarks, likenesses, recordings, scripts, images, and other materials you provide. You authorize CinemaMachina to use those materials solely to perform the agreed services.
4. Generative production
Generative systems can produce variation and unexpected details. CinemaMachina applies creative review and editing but does not guarantee pixel-level repeatability or that every generated element is unique. Clients are responsible for their own legal clearance of final public uses unless a written agreement states otherwise.
5. Fees and payment
Fees, deposits, milestones, expenses, and cancellation terms are stated in the applicable proposal or invoice. Amounts paid for completed work and committed production resources are nonrefundable unless the written project agreement states otherwise.
6. Review and acceptance
Clients agree to provide consolidated, timely feedback. A deliverable is accepted when approved in writing, published by the client, or not disputed within the review period stated in the project agreement.
7. Intellectual property
Upon full payment, the client receives the usage rights described in the project agreement. CinemaMachina retains its pre-existing tools, methods, templates, systems, know-how, and unused development materials. Portfolio use requires the permissions stated in the project agreement.
8. Confidentiality
Each party will use reasonable care with confidential project information. Unlisted review links are intended only for the client and authorized collaborators and should not be redistributed without permission.
9. Disclaimer and limitation
Services and websites are provided on an as-available basis. To the fullest extent allowed by law, CinemaMachina is not liable for indirect, incidental, special, or consequential damages. Total liability for a claim will not exceed the amount paid for the service giving rise to that claim.
10. Governing law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Before filing a claim, the parties agree to make a good-faith effort to resolve the issue directly.
